1. Heard.

2. Learned counsel for the petitioner would submit that the petitioner is working as Assistant Engineer in the Department of Rural Engineering Services (RES). The petitioner is aggrieved by the respondents' action of paying Rs.800/- less than what he is entitled for towards his monthly salary on the basis of the pay scale applicable to his post. He would submit that the less

payment has started from October 2013 when the petitioner was posted at Sarguja Division at Ambikapur. Presently, the petitioner is posted at Jagdalpur. He would draw attention of the Court to the communication issued from the ofÏce of Superintending Engineer, RES, Surguja Division on 2.12.2014 (Annexure P/4) informing the petitioner that the less payment is happening because of a clerical mistake.

3. Considering the entire facts' situation of the case and the nature of issue brought before this Court, it is deemed appropriate that respondent No.2 should look into the matter and decide the petitioner's representation for the alleged less payment of salary by Rs.800/- per month.

4. Let the petitioner prefer representation before respondent No.2 within a period of 04 weeks from today and thereafter, the said ofÏcer shall decide the matter in consultation with the Superintending Engineer, RES, Surguja Division, Ambikapur, at the earliest, preferably within a period of 02 months from the date of submission of representation.

5. It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall decide the matter, on its own merits, strictly in accordance with law, without treating any observation made in this order as opinion on the merits of the case.
