The transfer order is under challenge on the ground that while transferring the petitioner, the policy of the State Government to keep husband wife together as far as possible and subject to exigency of service, has not been kept in view.

Learned counsel for the petitioner submits that the petitioner is posted as Rural Agriculture Development Officer at Aundhi, Patan, District Durg and the husband of the petitioner is posted at Supela, Bhilai, District Durg as Pharmacist which is about 20 km. away. Now, by the impugned order, the petitioner is being transferred to the office of Deputy Director at Bemetara which is about 120 km. 3.

On petitioner's own showing, the petitioner has completed almost four years of posting at the present place. Therefore, the petitioner has become due for transfer. However, considering that the husband of the petitioner is also posted in Government service, the respondent may explore the possibility of posting petitioner and her husband at same stations or at nearby stations as far as possible and subject to administrative exigency.

However, there is no document to show that the petitioner has preferred representation. Therefore, it is directed that in case, the petitioner prefers representation within ten days from today, the same shall be considered and decided by the respondent within a period of four weeks keeping in view its own policy of adjusting husband wife together at same stations or at nearby stations as far as possible and subject to exigency of service.

The petition is accordingly disposed off.
