Sam Koshy Order On Board 23/08/2016 This is the fourth bail application filed u/s 439 of Cr.P.C. for grant of bail to the applicant who was arrested on 04.04.2014 in connection with Crime No. 74/2014 registered at Police Station Tarbahar, District Bilaspur for the offence punishable under Section 22 of the NDPS Act, 1985.

The First, second and third bail applications of the applicant were rejected by this Court vide order dated 30.06.2014, 20.08.2015 & 08.04.2016 respectively.

Counsel for the applicant submits that while dismissing the third bail application vide order dated 08.04.2016, this Court had specifically directed the Trial Court to conclude the trial expeditiously. He submits that though there is an order of expeditious trial, the concerned Court below itself is lying vacant for quite sometime and there is no likelihood of the trial being concluded at the earliest. Hence, counsel for the applicant prays that the applicant may be released on bail at this juncture.

However, it has been informed that steps have been taken to notify the Court once again as the earlier Court has got transferred as promotion.

In view of the same, this Court is of the opinion that ends of justice would meet if the M.Cr.C. is disposed of with a direction to the trial Court for ensuring expeditious conclusion of the trial keeping in

view the long pendency of case in the Court below. 6.

With the aforesaid direction, the present M.Cr.C. stands disposed of.
