NAFR HIGH COURT OF CHHATTISGARH, BILASPUR Writ Petition (S) No.3973 of 2016 Bhagirathi Sahu S/o Late Tulsi Sahu, Aged About 48 Years Posted As a Upper Division Teacher At Govt. Middle School, Singhori, Block Berla, District Bemetara Chhattisgarh ---- Petitioner
Versus
1.
State Of Chhattisgarh Through The Secretary, Department Of Education Development, Mahanadi Bhawan Mantralaya, New Raipur Chhattisgarh 2.
Collector, Bemetara District Bemetara Chhattisgarh 3.
District Education Officer, Bemetara District Bemetara Chhattisgarh ---- Respondents For Petitioner :
Mr. Akhilesh Mishra, Advocate For Respondent-State :
Mr. Raj Kumar Gupta, Dy. Advocate General Hon'ble Shri Manindra Mohan Shrivastava, J.
Order on Board 23/08/2016 Heard on admission.
1.
The transfer order is under challenge on the ground that the petitioner has been transferred within a short period without there being any complaint. The other ground is that if the petitioner is shifted, there may be reduction in the strength of teacher, which may adversely affect teaching. 2.
According to the transfer policy, which is not under challenge, transfer has become due after one year of posting. Therefore, there is no violation on this aspect, because the petitioner has completed more than one year at the present place of posting and the transfer of the petitioner has been done within same district about 70 Kms only. It is not the case of the petitioner that after his
transfer, school will be left with no other teacher. Therefore, I am not inclined to interfere with the transfer order.
3.
Accordingly, the petition is dismissed.
