1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.104/2011 (Criminal Case No.1630/2013 pending in the Court of Chief Judicial Magistrate, North Bastar Kanker) registered at Police Station Pakhanjur, Distt. North Bastar Kanker, for the offence punishable under Section 409 read with Section 34 of the IPC.

2. This is the second bail application filed on behalf of the applicant for grant of regular bail. First bail application has been dismissed on merits vide order dated 30-9-2013 passed by a coordinate Bench of this Court in M.Cr.C. No.4435/2013.

3. After hearing learned counsel for the parties, I do not find any case for entertainment of the second bail application since ten witnesses have already been examined. The application is, therefore, rejected. However, the trial Court is directed to expedite the trial and conclude the same within three months from the date of receipt of a copy of this order.
