Hon'ble Shri P. Sam Koshy, J Order On Board 18.09.2015 The grievance of the Petitioner is to the order dated 31.7.2012 whereby the services of the Petitioner were transferred from Takhatpur, Bilaspur to Phaduridihari, Distt. Surguja. The Petitioner had got an interim order in his favour on 3.1.2013 and by virtue of the said order, he continued at the said place of posting.

In view of the fact that the Petitioner has enjoyed the benefit of the interim protection for over two years, by efflux of time, the grievance of the Petitioner stands redressed and the petition has become infructuous. 3.

Accordingly, the Petition is dismissed as having become infructuous. 4.

Needless to mention that since the order had been passed almost two years back, the State counsel shall not insist upon the compliance of the

impugned order and the State however shall have the liberty to pass a fresh order in case the need so arises.
