-1NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPS No. 4025 of 2016 Keshlal Paikra S/o Shri Dhansingh Paikra, Aged About 41 Years Rural Agriculture Extension Officer, Agriculture Division, Block Gaurela, District Bilaspur, (Chhattisgarh) ---- Petitioner
Versus
State Of Chhattisgarh Through The Secretary, Department Of Agriculture, Mahanadi Bhavan, Mantralaya, New Raipur, District Raipur, (Chhattisgarh) ---- Respondent For Petitioner :
Shri Ajay Shrivastava, Advocate For State :
Shri Gary Mukhopadhyay, Dy. Govt. Advocate S.B.:
Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 24/08/2016 Heard on admission.
1. The transfer order is under challenge on the ground that while transferring the petitioner, the policy of keeping the husband and wife together at the same place as far as possible subject to administrative exigency has not been kept in view. It is submitted that the petitioner is posted as Rural Agriculture Development Officer at Gourela and his wife is also posted as Ward Aaya in Community Health Centre at Gourela. Now the petitioner has been transferred from Gourelal to Mahasamund which is far away from present place of posting.
2. The petitioner, on his own saying, has completed normal tenure of service as he has remained posted at the present place since 2009. Therefore, there is administrative exigency to transfer him. However, considering
-2that there is a policy of Govt. to keep husband and wife together at the same or nearby station subject to administrative exigency, the case of the petitioner requires consideration by the respondent-authority to explore the possibility of keeping the petitioner and his wife together at the same or nearby station.
3. The petitioner has not submitted any representation on this ground. Therefore, it is directed that if the petitioner wants to take benefit of this order, he should prefer representation within a period of 10 days from today. Upon receipt of such representation, the decision shall be taken by the authority within a period of 4 weeks.
4. With the aforesaid observation and direction, the petition is finally disposed off.
