Proceedings through Video Conferencing Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 30/06/2020

1. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.09/2020, registered at Police Station Mahila Thana, Raipur, District Raipur C.G. for offences punishable under Sections 498-A, 506, 34 of the IPC.

2. Marriage between the applicant and the complainant was solemnized on 08.03.2019. According to the FIR lodged on

MCRCA No. 432 of 2020 22.01.2020, the applicant demanded dowry of ₹ 30,000/- and used to beat the complainant regularly in a state of intoxication. According to the applicant dispute occurred on the complainant's insistence to join job at Bhilai only and not in the place where husband is residing.

3. Learned State counsel would oppose the prayer for anticipatory bail.

4. Considering the entire fact situation of the case, this Court is inclined to extend the benefit of anticipatory bail. Accordingly, the application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- (I) he shall make himself available for interrogation by a police officer as and when required;

(ii) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
