NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WPL No. 3746 of 2007 • Sachiv Vidyut Nagar Shiksha Samiti, Korba (W) (CG) Through Prafulla Kumar Moghe S/o Late Shri K.S. Moghe, aged about 46 years, Secreaary, Vidyut Nagar Shiksha Samiti Korba (W), Resident of CSEB, Korba West, District - Korba (C.G.) ---- Petitioner
Versus
1. Shiv Prasad Singh S/o Late Maiku Singh, Resident of Quarter No. 93, Shivaji Nagar Korba, Tahsil and District Korba (C.G.)
2. Controlling Authority Under The Payment Of Gratuity Act, Through Assistant Labour Commissioner, Korba, District. Korba (C.G) ---- Respondents For Petitioner:
None.
For Respondent No.1 :
Mr. I. Sen Sahu, Advocate Hon'ble Shri Justice P. Sam Koshy Order on Board 03.03 .2
1. The present Petition is of the year 2017. Today is last working week. There has been no representation on behalf of the Petitioner in the entire week.
2. The record shows that the matter in the past has also been dismissed on a couple of occasions i.e. on 04.08.2014 and again on 18.11.2016. On both the occasions the Petitioner had filed M.C.C. to get the Writ Petition restored. Surprisingly today also when the matter on two rounds was called there is no representation by the Petitioner. It appears that the Petitioner herein is in
the habit of not appearing after the Writ Petition is getting restored and is not willing to finally argue the matter.
3. In the absence of any representation on behalf of the Petitioner this Court is constrained once again to dismiss the Petition for want of prosecution.
