The transfer order is under challenge firstly on the ground that the petitioner has remained posted in the scheduled area for the last three years and this time, when occasion arose for transfer, she has been posted to another place within the same district without posting her outside the scheduled area. The other ground is that the husband of the petitioner has now been transferred to Surajpur and parents and inlaws of the petitioner are old aged and residing at Bilaspur, and therefore, the case of the petitioner warrants interference.

Learned counsel for the petitioner submits that the petitioner has already made representation stating her grievances and prayed for cancellation/modification of her transfer order.

The grounds, which have been raised by the petitioner, do not warrant interference by this Court. This petition has been filed by the petitioner and not by her husband, and therefore, as far as transfer of petitioner's husband is concerned, this Court cannot interfere. It is found that the petitioner has remained posted in the scheduled area for the last three years. There are other family difficulties stated before the Court. All other grounds may be considered by the respondent authority and decision shall be taken within a period of four weeks. 5.
