2. WPC No.2389/2014 was subsequently converted into

2 CONT No. 267 of 2019 WPPIL No.100/2017. The PIL was disposed of on 03.10.2017 in the following manner:- "1. Learned counsel for the Petitioner submits that in view of the return filed by the State, it would be sufficient if those pleadings are recorded and the writ petition is ordered accordingly.

2. We record the pleadings of the State and order the writ petition accordingly."

3. Learned counsel for the applicant would draw attention of the Court to Para 5 of the return filed in the writ petition on the basis of which the PIL was disposed of. In Para 5 of the return, State has made a statement that presently the above land has been vacated and there is no any encroachment on the said land.

4. Since the writ petition was disposed of recording the statement made in the return, in effect, the writ petition was dismissed as infructuous because the State raised a plea that encroachment has already been removed.

5. No contempt is made out by any of the respondents. Hence the contempt petition is dismissed.
