1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.214/2013 {ST No.22/2014 pending in the Court of Additional Sessions Judge (FTC), Ambikapur}, registered at Police Station Seetapur, Distt. Surguja, for the offence punishable under Sections 363, 366A of the IPC, 3 and 4 of the Protection of Children from Sexual Offences Act, 2012.

2. Case of the prosecution, in brief, is that the applicant is said to have abducted a minor girl for the purpose of illicit sexual intercourse and thereby committed the offence.

3. I have heard learned counsel for the parties and perused the case diary.

4. Learned counsel for the applicant submits that the applicant has not committed any offence, he has been falsely implicated in the case and he is in custody since 2-1-2014. He further submits that the girl is not yet

recovered and all the prosecution witnesses have been examined.

5. On the other hand, learned State counsel opposes the application.

6. Taking into consideration the nature and gravity of offence, age of the prosecutrix, material collected by the prosecution and statements of the prosecution witnesses examined, I do not consider it a fit case for grant of regular bail to the applicant.
