Learned counsel for the petitioner would submit that the respondent Nos. 5 and 6 have encroached upon the agricultural land belonging to the petitioners and are excavating soil causing
immense harm to the petitioner.

Let the petitioner move before the concerned Tehsildar within 15 days from today, on such application being filed the Tehsildar shall demarcate the area, and if it is found that the above respondents have encroached any part of petitioner's land, the Tehsildar shall pass necessary orders after providing opportunity of hearing to the said respondents.

The Tehsildar shall pass necessary orders within three months from the date of submission of application.

Petitioner may also move an application for interim relief before the Tehsildar and the Tehsildar shall pass an order on the said application within a week.
