1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.52/2015 (Criminal Case No.4783/2015 pending in the Court of Chief Judicial Magistrate, Durg), registered by the Excise Sub Inspector, P.S. Dhamdha, Circe Dhamdha, Distt. Durg, for the offence punishable under Section 34 (2) of the Chhattisgarh Excise Act, 1915.

2. Case of the prosecution, in brief, is that 52.920 bulk liters of illicit liquor was seized by the police from the present applicant.

3. Taking into consideration the nature and gravity of offence and the provisions contained in Section 59-A (ii) of the Chhattisgarh Excise Act, 1915, I am not inclined to grant bail to the applicant.
