Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 2 4 /0 8 /201 (1) Learned counsel for the petitioner submits that charge sheet has been issued to the petitioner that he has withdrawn Rs.2,81,439 in excess of what he is entitled. He further submits that despite interim order passed by this Court on 4.5.2001, the aforesaid amount has been recovered from the petitioner. He further submits that petitioner has already been retired from services on 31.05.2003 and, therefore, respondents-CESB be restrained from taking any action against the petitioner on the basis of charge sheet issued to the petitioner. (2) Be that as it may, the petitioner has already been retired from services 13 years back from the Chhattisgarh State Electricity Board
and that amount in dispute has already been recovered from the petitioner by the CSEB, considering the feasibility of closing the case against the petitioner; the petitioner is directed to file representation before the respondents - authorities for redressal of his grievances and in turn the respondent-Chhattisgarh State Electricity Board is directed to consider and decide the same in accordance with law expeditiously preferably within a period of one month from the date of receipt of certified copy of this order affording due opportunity of hearing to the petitioner. However, the petitioner is at liberty to proceed further depending upon the result of his representation.
(3) With the aforesaid observations, the writ petition stands finally disposed of.
