(1) This is the second bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested on 30.05.2015 in connection with Crime No.162/2015 registered at Police Station Police Chowki -Gidhpuri, P.S. Palari, Distirct Balodabazar Bhatapara (C.G.) for the offence punishable under Sections 3, 7 of the Essential Commodities Act, 1955. (2) The first bail application of the applicant was dismissed on merits by order of this Court dated 25.06.2015 passed in M.Cr.C. No.2851/2015.
(3) Learned counsel appearing for the applicant submits that the applicant has been falsely implicated in the case and the applicant is in jail since 30.05.2015; and the investigation has been completed and the charge-sheet has already been filed, therefore, the applicant may be released on bail.
(4) On the other hand, learned counsel for the State opposes the bail application.
(5) After hearing learned counsel for the parties and taking into consideration the facts and circumstances of the case, the application after filing of the charge-sheet and perusal of the record, I do not find any new or good ground to entertain the second bail application, therefore, the second bail application is rejected. However, the trial Court is directed to expedite the trial and conclude the same preferably within a period of two months from the date of receipt of copy of this order.
