1. Heard.

2. The present petition is against the show-cause notice dated 27.02.2021 issued by the Collector, Jagdalpur.

3. Learned counsel for the petitioner would submit that in terms of the policy of the State, the petitioner purchased a land on 08.09.2020 from the State vide Annexure P-4. She would further submit that subsequently the petitioner was served with a show-cause notice dated 27.02.2021 wherein the said settlement is sought to be canceled. The letter is received from the Collector, Bastar. She

would further submit that the petitioner has obtained loan after purchase of the property and has started construction and once the sale having been made, the same cannot be canceled.

4. After perusal of notice dated 27.02.2021 (Annexure P-1), it appears that it is only a show-cause notice and the petitioner can reply to the same and no action as on date has yet been taken. Considering the same, it is observed that the petitioner may file the reply to the aforesaid notice and if certain orders are passed, the petitioner shall have the liberty to challenge the same before the appropriate forum to seek the remedy available under the common law.

5. Accordingly, the petition is dismissed.
