1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.259/2014 (ST No.14/2015 pending in the Court of Additional Sessions Judge (FTC), Ambikapur), registered at Police Station Gandhi Nagar, Distt. Sarguja, for the offence punishable under Sections 363 and 364A read with Section 34 of the IPC.
2. Case of the prosecution, in brief, is that the applicant and other coaccused have abducted / kidnapped one Om Prakash, aged 5 years, on 2-12-2014 for ransom.
3. Learned counsel for the applicant submits that the applicant has not committed any offence, he has falsely been implicated in the case, he is in custody since 3-12-2014 and therefore, he may be released on bail.
4. On the other hand, learned counsel for the State opposes the bail application and submits that bail application of co-accused Devendra
Singh has been rejected by this Court vide order dated 7-7-2015 passed in M.Cr.C.No.1948/2015.
5. I have heard learned counsel appearing for the parties and perused the case diary.
6. Taking into consideration the nature and gravity of offence, material collected by the prosecution against the applicant and the fact that bail application of co-accused has been rejected, I am not inclined to grant regular bail to the applicant.
