The grievance of the petitioner is that of none regularization of the petitioner though he has working with the respondent since1991. 2.

The claim of the petitioner for regularization was rejected on the ground that he is not 5th pass. The petitioner vide the present Writ Petition referred to (Annexure P-4) which shows that he has infact passed 5th standard way back in the year 1995.

According to the petitioner himself he for some reasons could not bring the certificate to the notice of the respondent at the relevant point of time nor was this entered into the service book of the petitioner. Under the given facts and circumstance let the petitioner now make a fresh representation to the respondent No.3, supported with all relevant documents and his

credentials in respect of his Educational Qualification and the respondent in turn may consider case of the petitioner a-fresh and shall pass an appropriate order in accordance with rules.

Needless, to mention that the respondent would also have the liberty to getting the document dully verified before passing of any order in respect of the claim raised by the petitioner.
