Hon'ble Shri Justice P. Sam Koshy Order On Board 17/07/2015 The petitioner through the instant petition has raised his grievance pertaining to the arbitrary action on the part of the respondents in not granting promotion to him to the post of Dresser Grade-1 from the present post of Dresser Grade-II.

Counsel for the petitioner submits that so far as the Dresser Grade-II in the other District of Chhattisgarh is concerned, their cases have already been

considered and they have been granted promotion as early as June, 2013 and October, 2013 but the petitioner has been denied. He further submits that the petitioner has already made repeated representations to the respondents but the same till date have not been decided.

At this juncture, without entering into the merits of the case this Court feels it appropriate to dispose of the writ petition directing the respondent No.3 to consider and decide the representation of the petitioner. Accordingly, the instant writ petition is disposed of with a direction to respondent No.3 to decide the representation of the petitioner in accordance with law within a reasonable period.

Needless to mention that in the event if the respondents find that the petitioner is not entitled for the relief claimed for, the representation shall be objectively decided by a speaking order communicating the same to the petitioner.
