The sole grievance of the Petitioner in the instant case is that in spite of the Petitioner being Lecturer (Panchayat) and posted at the Government Higher Secondary School, Basdei as In-charge Principal, the Respondent No.3 recently vide order dated 24.2.2018 (Annexure P-1) has ordered giving the charge of Principal to Respondent No.4 who is only a Headmaster of Government Middle School, Uchdih. 2.
Contention of the Counsel for the Petitioner is that the Petitioner being the Lecturer is competent and eligible to be posted as Principal at Government Higher Secondary School whereas Respondent No.4 is only competent for a post of Headmaster at Government Middle School and status-wise also the post of the Petitioner is superior to Respondent No.4 and therefore the charge which was to be given was to the Petitioner instead of Respondent No.4.

This Court is of the opinion that this being the limited grievance of the Petitioner, no purpose would serve in keeping the petition pending any further. Let the Petitioner file a fresh representation/objection to Respondent No.3 in continuation to what he has already filed on 1.3.2018 and the same may be decided by the Respondent No.3 objectively as expeditiously as possible within a period of 45 days from the date the order of this Court is made available to the Respondent No.3. The Petitioner to file his objection/representation to the Respondent No.3 along with a copy of this order as early as possible.

Counsel for the Petitioner submits that the Petitioner till date is discharging his duties as In-charge Principal at the Government Higher Secondary School. This being the fact, let status-quo as it exists today be maintained till the objection of the Petitioner is decided by the Respondent No.3.
