Ms. Sunita Jain, Panel Lawyer Order On Board 04/08/2015 The applicant has preferred this application under Section 438 of Cr.P.C., apprehending his arrest in connection with Crime No.31/2015, registered at Police Station-Ganj, District Raipur for alleged commission of offence under Sections 420 of IPC .

Case of the prosecution is that the applicant recovered Rs.3,10,000/- from the complainant in the name of providing job to his son and thereby cheated him. 3.
Learned counsel for the applicant submits that the applicant has been falsely implicated and against the complainant, number of criminal cases are registered and the applicant being a Police Constable, he is being pressurized by the complainant for lodging false report. It is further submitted that one of the witness-Abdul Jakariya Khan, during the departmental enquiry, did not support the allegation that any payment was made in his presence.

On the other hand, learned State counsel opposed the prayer for grant of bail
by submitting that more than one person has stated that the money was paid in their presence to the applicant by the complainant by selling his own land for Rs.6 Lakh to one Prabhu Ram Sahu.

Considering the nature of allegation and the material available on record, I am not inclined to grant bail to the applicant.

Accordingly, the application is rejected.
