This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 230/2013, registered at Police Station-Hirri, District-Bilaspur (C.G.), for the offence punishable under Section 429/34 of the IPC and Sections 4, 6 & 10 of the Agricultural Cattle Preservation Act, 2004.

Taking into consideration the facts and circumstances of the case; further taking into consideration the nature and gravity of offence, also considering the fact that charge-sheet was filed against co-accused person on 11.3.2013 and the present applicant remained absconding, whereas trial has concluded since the applicant neither co-operated in the investigation nor in the trial and his presence should be secured only after issuing standing warrant of arrest, as such, his act demonstrates that he is in habit of

non-cooperation in the trial and investigation, this Court is not inclined to release the applicant on regular bail.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
