(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No. 46/2015 registered at Police Station - Civil Line, Raipur, District Raipur for the offence punishable under Section 420/120(B) of the Indian Penal Code.

(2) Case of the prosecution is that on applicant along with other co-accused persons obtained Rs. 32,00,000/- from the complainants promising to double the amount and thereby cheated the complainants.

(3) Counsel for the applicant would submit that applicant has falsely been implicated in the offence in question as he has not committed any offence. He further submits that the applicant is in jail since 30.04.2015 and, therefore, the applicant may be released on bail.

(4) On the other hand, counsel for the State opposes the bail application.

(5) Taking into consideration the nature and gravity of the offence and the manner in which the huge amount has been collected by the applicant for doubling the same from the complainants, I am not inclined to release the applicant on bail. Therefore, the bail application is rejected.
