1. The issue involved in the present case is squarely covered by the decision of this court in case of Dako Vs. South Eastern Coalfields Ltd. (WPS No. 1299 of 2018) decided on 08.02.2018.

2. The said writ petition, in turn, was decided on the basis of earlier decision of this court in case of Babu Vs. South Eastern Coalfields Ltd. and Others (WPS No. 6916 of 2017) decided on 11.12.2017. The nature of allegations in the charge sheet in the present case appears to be similar as in the case of Babu (Supra) so also in case of Dako (Supra).

3. Given the facts and circumstances of the case, the present writ

petition also stands disposed of in similar terms. The respondents shall withdraw the charge sheet dated 25.10.2017 and shall, if they feel so, issue fresh charge sheet giving the details of charges and also providing list of witnesses and documents which they intend to rely upon during the course of inquiry as is envisaged under the provisions of the Service Rules governing the petitioner.
