The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No. 43/2016 registered in Police Station Arang, District Raipur (C.G.) for offence punishable under sections 420, 406/34 of Indian Penal Code.

As per the prosecution case a report was made by 8 persons on 22/02/2016 that in the month of April, 2015 the applicants have collected paddy from different farmers and assured to make payment after one week but despite paddy was taken away but the amount was not paid, therefore offence is committed.

Learned counsel for the applicants submits that applicants have been falsely implicated in the case. He submits that there has been some dispute about payment of money which led to such dispute and the nature of offence as alleged would be of civil nature, charge sheet in this case
has been filed, therefore, learned counsel submits that the applicants may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 5.
I have perused the case diary. Taking into fact that charge sheet has been filed, no further investigation is necessary and applicants are in jail since 4/02/2016, this court is inclined to release the applicants on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicants shall be released on each of them furnishing personal bond for a sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of concerned trial court for their regular appearance before it as and when directed.
