Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 28/03/2016 Heard.

This petition has been filed by the petitioner aggrieved by the alleged action of the authorities in demolishing the boundary wall and shop of the petitioner.

The allegation of the petitioner is that the shop and boundary wall has been demolished illegally without the authority of law. It is submitted that the petitioner had submitted representation to the Collector making specific allegations against a revenue officer but no action has been taken. The petitioner has also claimed compensation.

According to the petitioner, himself, demolition has taken place. Therefore, in these circumstances, in the opinion of this Court, the petitioner has an alternative and efficacious remedy of seeking appropriate compensation on proof of the allegations by taking recourse to the remedy of filing civil suit.

As far as complaint of the petitioner to the Collector is concerned, the Collector shall consider the same, hold an enquiry into the allegations and take a decision on the complaint.

With the aforesaid observations and liberty, the petition is disposed off.
