HIGH COURT OF CHHATTISGARH, BILASPUR Order Sheet REVP No. 72 of 2019 R. N. Gupta Vs. State of Chhattisgarh 05.04.2019 Mr. R. N. Gupta, Petitioner in person.

Mr. Rahul Mishra, Dy. GA for the State.

The present writ petition has been filed seeking review of the order dated 23/01/2019 passed in WPS No. 2925/2014. Petitioner in person refers to the order passed by this Court in paragraph 10, For ready reference reproduced hereinunder :- Taking into consideration the aforesaid legal "

position as it stands this Court is of the opinion that the petitioner has made out a strong case for grant of interest on belated release of his leave encashment and gratuity amount.''

Thereafter the petitioner refers to the paragraph 11 of the order, which is reproduced hereinunder:- Accordingly, the writ petition to the aforesaid "

extent stands allowed and it is ordered that the petitioner shall be entitled for interest @ 9% per annum on leave encashment and gratuity paid to him. The interest shall be payable from the date it fell due till the date it has been released to the

petitioner."

Wherein while passing the order this Court seems to have inadvertently not mentioned the amount of gratuity also which would carry interest. The contention of the petitioner seems to be well founded. Accordingly the order dated 23/01/2019 deserves to be reviewed and the present review petition to that extent stands allowed. The order dated 23/01/2019 passed in WPS No. 2925/2014 therefore stands recalled and it is ordered that the said petition be listed for final disposal at motion stage on 15/04/2019. Let a copy of this order be made part of records of WPS No. 2925/2014.
