The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.68/2021 registered in Police Station Jarhagaon, District Mungeli for offence punishable under Sections 34(1- p ) & 34(2) of Chhattisgarh Excise Act. 2.
As per the prosecution case on 10/03/2021 on a raid being conducted from the possession of the applicant 205 bulk liters of liquor was seized, therefore the applicant was arrested. 3.
Learned counsel for the applicant submits that the applicant is in jail since 10/03/2021, charge sheet has been filed, no further investigation is necessary, therefore the applicant may be enlarged on bail.

Learned State counsel opposes the prayer for grant of bail and would submit that two cases are registered against the applicant, one is under Section 36 of the C.G. Excise Act and another is under Section 34(1) of the C.G. Excise Act.

Considering the fact that charge sheet has been filed, offence is triable by Judicial Magistrate First Class and the applicant is in jail since 10/03/2021, this Court is inclined to release the applicant on bail. 6.
Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
