This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.
The applicant has been arrested in connection with Crime No.255/2018-19 registered at Police Station- Excise Circle(B) Rajnandgaon, Civil and Revenue District- Rajnandgaon (C.G.) for the offence punishable under Section 34 (2) of CG Excise Act.

Case of the prosecution, in brief is that on 27.02.2019, 30.600 bulk liters of foreign liquor was seized from the possession of the applicant. 5.
Counsel for the State submits that two other criminal cases have been registered against the applicant , out of which 1 under Excise Act and another under CrPC. 6.
Looking to these facts and circumstances of the case, the application is allowed. It is directed that if the applicant furnishes two solvent sureties for a sum of Rs. 25,000/- along with a personal bond of Rs. 50,000/- to the satisfaction of the trial Court concerned Trial Court with condition that he will not involve in any crime in future, he will appear before the Trial Court at 11:00 am as and when directed till trial and he would cooperate during the trial, he shall be released on bail. 7.
