This is the first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and no other bail application is pending before any other Court.

Perused the case diary provided by the learned counsel for the State in connection with Crime No.63/2019 registered at Police Station- City Kotwali, District- Raipur (C.G.) for the offence punishable under Sections 294, 323, 506 B, 324, 341 of Indian Penal Code and 25, 27 of Arms Act.

Case of the prosecution, in brief is that on 12.02.2019 at about 3:30 pm at Mahitosh Chauk Kakali Talab, Raipur, applicant and coaccused abused complainant Akram Khan @ Kalu, threatened to kill him, applicant caused injury on her left thigh by spring knife.

Learned counsel for the applicant submits that applicant has no criminal background, he is innocent and has been falsely implicated in the present case, therefore, he shall be released on bail.

Counsel for the State submits that 4 other criminal cases have been registered against the applicant.

Looking to the facts and circumstances of the case, looking to this fact that 4 other criminal cases have been registered against the applicant, this Court is not inclined to get benefit of Section 439 of CrPC to the applicant, consequently the present bail application is rejected.
