1. The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he is in jail since 27.02.2021 in connection with Crime No. 245/2021 registered in Police Station Ranitarai, District Durg (C.G.) for the offence punishable under Section 34 (2) of C.G. Exicise Act.

2. It is stated by learned counsel for the State that there are three criminal antecedents including present one of the applicant.

3. Learned counsel for the applicant seeks to withdraw this application with liberty to file a fresh application as and when occasion arises.

4. Accordingly, the application is disposed of as withdrawn with the liberty as stated above.
