Shri Ashok Kumar Shukla, Advocate Hon'ble Shri Justice P. Sam Koshy Order On Board 28/03/2018 Present contempt petition has been filed on the ground of willful deliberate non-compliance of the order passed by this Court on 04.07.2017 in WPS No. 1218 of 2016.

For proper understanding of the case, it would be necessary to reproduce paragraph-5 of the said order by which the writ petition stood disposed of:

"5. Accordingly, the present writ petition, at this juncture, stands disposed of with a direction that all endeavors shall be made by the department to ensure that Departmental Enquiry pending against the petitioner shall be concluded at the earliest preferably within a period of six months from the date of receipt of copy of this order."

Counsel for the petitioner submits that subsequent to the disposal of the writ petition, except for a notice issued on 17.10.2017 by the Additional Collector, no further proceeding has been drawn thereafter. 4.

Given the facts, more particularly considering the fact that the enquiry officer was not a party in the writ petition which was filed by the petitioner, this court is of the opinion that ends of justice would meet if the present contempt petition is disposed of with a direction to respondent no.2 to ensure that the departmental enquiry is concluded at the earliest preferably within a period of 4 months from the next date of enquiry which is given by the Additional Collector. It is directed that the respondent no.2 shall make all endeavours for concluding the trial within the said period failing which he himself would be responsible for the consequences.
