Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 06/12/2017
1. Petitioner earlier challenged the transfer order dated 31.08.2017 issued by the Janpad Panchayat, Pithoura on
the ground that much before the said order he had already withdrawn the application for mutual transfer with the respondent No. 4 Dinesh Pradhan. This Court directed the concerned authority to consider the petitioner's representation and by the impugned order the earlier transfer order has been kept intact.
2. Perusal of the order Annexure P-1 does not indicate that the ground urged by the petitioner either in the writ petition or in his representation has been considered objectively by Janpad Panchayat, therefore, the matter is remitted back to the Janpad Panchayat, Pithoura for passing fresh, reasoned and speaking order on the petitioner's representation which he had already preferred.
3. Let the Janpad Panchayat, Pithoura decide the representation, as above, within 2 months from today. For a period of 2 months or till the representation is considered afresh, the status-quo in respect of petitioner's posting, as obtaining today, shall be maintained.
