Delay in filing the restoration application is hereby condoned.

(3) Counsel for the petitioner is heard on restoration application. (4) The petitioner is seeking restoration of Writ Petition No.4028 of 2003 which was dismissed for want of prosecution vide order dated 12.04.2017. (5) On due consideration of the submission of the learned counsel for the petitioner and the grounds taken in the restoration petition, I am satisfied that the absence of the petitioner's counsel on 12.04.2017 when Writ Petition No.4028 of 2003 was taken-up for hearing was based on bona fide grounds.

(6) M.C.C. No. 246/2018, therefore, is allowed and Writ Petition No.4028 of 2003 is restored to its original number.
