This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.155/2013, registered at Police Station-Kawardha, Distt.Kabirdham (CG), for the offence punishable under Sections 366 and 376/34 of the IPC.

After hearing learned counsel appearing for the parties, taking into consideration the facts and circumstances of the case and taking note of the fact that the applicant is accused in the offence under Section 376 of the IPC and remained absconded from 2013 and arrested only on 10.7.2015, this Court is of the opinion that present is not a fit case, in which, the applicant should be enlarged on regular bail.

Accordingly, the bail application filed under Section 439 of the

Cr.P.C. is rejected.
