1. The instant petition is of the year, 2007. The relief sought for by the petitioner in the instant case was for a direction to the respondents to consider the case of the petitioner for promotion to the post of Assistant Grade-III or any equivalent post.

2. The petition is pending consideration for 10 years. The reply of the State Govt. was also filed in the year, 2008 i.e. 9 years back. In paragraph 3 of reply itself the State has conceded the fact that the respondents shall be taken steps for holding Departmental Promotion Committee (for short DPC) and in case if the the petitioner is found eligible and suitable for promotion, his case shall be considered for promotion.

3. In the light of the aforesaid statement made in the reply of the State, this

court is of the opinion that nothing further remains to be adjudicated upon at this juncture. In case if the DPC in due course of time has not been held, it is directed that the respondents shall take a prompt measures for holding DPC and if the petitioner is found eligible and suitable, his case may also be considered for grant of promotion.
