Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 25-41. This is first bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court and his no bail application is pending before any other court.
2. The applicant has been arrested in connection with Crime No. 46/2019 registered in police station Gandai, Distt. Rajnandgaon (CG) for offence punishable under Section 420 and 471 of the IPC.
3. Perused the case diary.
4. Prosecution story in brief is that applicant projected himself as director of Serena Foundation. He promised 32 to 33 person to provide job in Serena Foundation. He also obtained Rs. 11,000/- from each candidate as security. Thereafter candidates got appointment orders. After 2 - 3 months they did not get salary. The applicant closed office and absconded. The applicant also obtained handsome amount from some candidates by giving them assurance that he will provide them loan from bank but he did not do so.
5. Counsel for the applicant argued that the applicant is innocent and falsely implicated. Charge sheet has been filed. The applicant is in jail since 10-2-2019. Hence he may be released on bail.
6. On the other hand, the State Counsel opposed the bail application.
7. Looking to the facts and circumstances of the case, looking to the seriousness of the alleged offence and also the impact of granting bail on the society, this Court is not inclined to grant bail to the applicant.
8. Consequently, the MCRC is dismissed.
