Heard on I.A. No. 1, which is an application for condonation of delay. On due consideration, the explanation given in the application is satisfactory, therefore, the delay of 159 days in filing the MCC is condoned.

This MCC has been preferred for restoration of W.P. No. 260/2001 which was dismissed for non-prosecution.

Considering the facts and circumstance and the reason assigned in restoration application being satisfactory.

In the opinion of this Court the present application for restoration is allowed.

The order dated 07/12/2015 is recalled.

W.P. No. 260/2001 is restored to its original number. No order as to cost.
