The present petition is filed for the reason that on a complaint made by the petitioner, the State Government conducted an enquiry against two of the officers i.e. Commissioner namely Pramod Shukla & R.P.Sonkar, who were posted in the Municipal Corporation Chirmiri and they were found guilty. Subsequently, certain amount was ordered to be recovered from them along with the stoppage of some increments.

It is stated that on the complaint of the petitioner, the order was passed by the State Government on 15.01.2015. Thereafter, an appeal though have been filed by the said persons but the appeal is not yet been decided by the State authorities despite passing of four years. Therefore, the State may be directed to decide the pending appeal preferred by Pramod Shukla & R.P.Sonkar within a reasonable time.

Learned State counsel submits that the appeal is pending against Pramod Shukla & R.P.Sonkar as per the Chhattisgarh Civil Services (Classification, Control & Appeal) Rules, 1966 and that would be decided within a reasonable period.

Considering the short issue, it is directed to the State that if the appeal preferred by Pramod Shukla & R.P. Sonkar is not decided, the same shall be decided within a further period of three months from the date of receipt of a copy of this order.
