This is second bail application seeking grant of anticipatory bail. The first one was dismissed on 16.6.2016 after hearing the parties on merits. As per the prosecution case, on 08.08.2015, complainant Shashank Verma was standing near the Mall. At that time, the applicant asked him to bring the Cigarette. When the complainant refused, the applicant called the other accused persons and thereafter, the complainant was assaulted by first and some injury was caused above the eye by sharp object and also Rs.1500/- was looted.

Learned counsel for the applicant submits that even the affidavit furnished by the complainant on

20.01.2016 was existing when the first bail was rejected. After going through the earlier bail rejection order, I do not find any change of circumstances in this case as the applicant is still at large.
