1. The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure, 1973 for releasing him on regular bail during trial in connection with Crime No.55/2015, registered at Police Station Bhupdevpur, Distt. Raigarh for the offence punishable under Sections 399, 402 of the IPC, 25 and 27 of the Arms Act.

2. Case of the prosecution, in brief, is that the applicant and four other coaccused persons were found making preparation to commit dacoity and thereby committed the offence.

3. Learned counsel for the applicant submits that the applicant has not committed any offence, he has been falsely implicated in the case and he is in custody since 11-4-2015. Challan has already been filed.

4. On the other hand, learned State counsel opposes the bail application and submits that the accused persons have planned for robbing ATM and to commit murder of security officer of SKS Ispat Ltd.. Sharp-edged weapon has been seized from the possession of the applicant.

5. I have heard learned counsel for the parties and perused the case diary.

6. Considering the facts and circumstances of the case and the material collected by the prosecution, I am not inclined to grant regular bail to the applicant. The application is, therefore, rejected. Sd/- (Sanjay K. Agrawal) Judge Soma
