Hon'ble Shri Justice P. Sam Koshy Order On Board 21.03.2018.

1. The petitioner seeks a direction to the respondents for concluding Departmental Enquiry proceeding initiated against the petitioner at the earliest.

2. The grievance of the petitioner is that, though a departmental enquiry was initiated against the petitioner one year ago and the inquiry officer also having submitted the enquiry report, the disciplinary authority has not taken any further action on the said enquiry report.

3. The petitioner makes a limited prayer that the respondents be directed to pass a final order at the earliest on the enquiry initiated against him, to which the counsel for the State does not dispute.

4. Given the factual matrix of the case, this petition is allowed and the

respondent No.4 is directed to ensure that disciplinary proceedings initiated against the petitioner is concluded at the earliest preferably within a period of 60 days from the date certified copy of this order is made available to him. It is the responsibility of the petitioner to make available the copy of this order to respondent No.4.

5. With the aforesaid observations, the writ petition stands allowed and disposed of.
