The present petition is against the order dated 16.02.2018 whereby the plaint has been returned in exercise of power under Order 7 Rule 10 of C.P.C. to be presented before the proper Court.

The order having been passed under Order 7 Rule 10 of C.P.C., the appeal would lie and the petition under Article 227 of the Constitution is not tenable. Therefore, the petition is dismissed at the admission stage itself.
