ORDER

03.07.2020 Heard

1. The petitioner seeks for redressal on the ground that he may be allowed to appear in the upcoming main examination of Civil Judge Class-II as the petitioner scored 78 marks which is more than cut-off marks of OBC candidate, which would find place in the order of the Division Bench passed in Writ Appeal No.605/2019 and other connected matters wherein it has been observed that cut-off marks for OBC candidate is 78. Therefore, the petitioner submits that he may be allowed to appear in the main examination.

2. Learned counsel for the Chhattisgarh Public Service Commission would submit that the petitioner has not challenged at any point of time any question of model answer. He placed on record on the closed envelop the marks obtained by the petitioner after amended model answer published on 22.06.2019 and the same is taken on record. According to it, the petitioner has obtained 77.2752 marks after the model answer is amended and published on 22.06.2019.

3. Considering the fact that the petitioner secured 77.2752 which is less than 78 which is the cut-off marks, the petitioner cannot be allowed to appear in the main examination.

4. In view of the above, the petition has no merit and accordingly is dismissed.
