This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No. 591/2012 registered at Police Station- Durg, District- Durg (C.G.) for the offence punishable under Sections 420, 467, 468, 471 & 409 of IPC. 2.
As per the case of the prosecution, the allegation against the applicant is that the applicant working as Assistant Grade-III in the Chhattisgarh Housing Board, Durg has signed the signature of the State Officer in the lease deed and executed the lease deed in the year 2011, and thereby committed the offence. 3.
Learned counsel for the applicant submits that the applicant has not committed any offence, the alleged offence is of the year 2011, there is no report of hand-writing expert which shows that the applicant has been falsely implicated and the charge-sheet has been filed, therefore, the applicant may be released on bail. 4.
Learned State counsel opposes the prayer for grant of bail. 5.
Perused the case diary and the documents.

Considering the facts and circumstances of the case and particularly considering that the document was executed by the Grah Nirman Mandal, the alleged offence is of the year 2011, the charge-sheet has been filed and the evidence is documentary in nature, therefore, I am not inclined to release the present applicant on bail. 7.
Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed.

It is directed that the applicant shall be released on bail on furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for his appearance as and when directed. 9.
