Only grievance of the petitioner is that the petitioner was convicted after serving of charge sheet, however he was not served with order of punishment. Subsequently, order of punishment was obtained under the Right to Information Act and thereafter appeal was preferred before the Collector on 3/04/2019, however same is not being decided till date. Only prayer of the petitioner is that the said appeal may be directed to be decided within a time frame.

Considering the fact and only prayer has been made to decide the appeal which has already been preferred as per Annexure P-3, therefore Collector, Gariyaband is directed to decide appeal of the petitioner within

a further period of three months from the date of receipt of this order. It is made clear that this court has not made any observation as to the merits or limitation of this case which would be decided by the Collector after taking into facts of the individual case.
