This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No.70/2015, registered at Police StationPateva, District-Mahasamund (C.G.), for the offence punishable under Section 20 (B) of the NDPS Act.

Taking into consideration the facts and circumstances of the case; further taking into consideration the nature and gravity of offence and also considering the quantity of contraband article ganja i.e. 18.700 kg., this Court is of the opinion that present is not a fit case, in which, the applicant should be enlarged on regular bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is rejected. However, the trial Court is directed to expedite the trial and conclude the same within four months from the date of receipt of copy of this order. Sd/- (Sanjay K. Agrawal) JUDGE B/-
