The challenge in the present Writ Petition is to the order Annexure-P/1 dated 08/03/2019 whereby the petitioner has been placed under suspension. 2.

From perusal of the record it reflects that, the order of suspension has been passed under Rule 9 of the Chhattisgarh Civil Services (Classification, Control and Appeal) Rules, 1966. That the said order is an appealable order under Rule 23 of the said Rules of 1966.

It appears that the petitioner has not preferred an appeal against the said order and have straight away filed the instant Writ Petition. 4.

In view of the same, this Court is not inclined to entertain the Writ Petition at this juncture.

Reserving the right of the petitioner to prefer an appeal if not made till date within a period of 10 days from today. That if an appeal is preferred within 10 days time, the Appellate Authority shall consider and decide the same on its merits within the period as prescribed under the Rules of 1966. 6.
