1. The challenge in the present writ petition is to the order of transfer dated 20.02.2019 Annexure P-1 whereby the petitioner has been transferred from District Rajnandgaon to District Surajpur on the post of Assistant Food Officer.

2. The two grounds which the counsel for the petitioner has raised are that the petitioner himself had in the past received head injury by way of an

-2assault made by some subordinate staff when the petitioner was posted at Kawardha for which the petitioner has to go for regular check up at Raipur. The second ground is that the daughter of the petitioner is suffering from serious heart ailment for which she is under constant treatment from Ramkrishan Care Hospital at Raipur. Counsel for the petitioner makes a limited prayer that the petitioner is not averse of being transferred from the present place of posting but makes a limited request that the authorities may consider transferring the petitioner to a place in and around Raipur or to any other nearby place with which he can have easy access to the medical treatment that he is presently undertaking both for himself as well as for his daughter.

Given the said fact, let the petitioner make a representation to respondent no.1 within a period of 10 days from the date of receipt of copy of this order supported with all relevant records in support of his contentions. That respondent no.1, on receipt of the said representation, shall take a decision within a period of 30 days thereafter. Till the representation of the petitioner is decided on merit by the respondent no.1, the effect and operation of the transfer order Annexure P-1 dated 20.02.2019 so far as the petitioner is concerned, shall remain stayed.
